Human rights require recognition, in time and space, of organizations and rules designed for their effective protection, still highly dependent on the constitutional systems of democratic nations and regional systems (ECHR, EU, Inter-American Convention, etc.). These legal systems constitute an area of fundamental rights and freedoms open not only to a purely national identitarian citizenship. This prospective is the first step toward a citizenship based on human rights, an inclusive citizenship that is able to answer the changes brought by the phenomenon of immigration.
