Abstract:
L’autore intende presentare all’attenzione degli studiosi un primissimo spaccato del mondo giudiziario penale padovano in relazione alla questioni scientifico forensi. La base di ricerca è quella dell’archivio del Maleficio del rettorato di Padova e il corpus enucleato fa riferimento al lavoro dell’avvocato Zorzi Marenzi tra il 1751 e il 1757. In particolare si mettono in evidenza le opzioni difensive di questo avvocato quando la sua attività incontra il problema del reato di aborto, e la strada che sembrano aprire in relazione all’utilizzo della consulenza scientifica di estrazione accademica nel processo. La città in oggetto è la sede tradizionale di una delle più prestigiose università occidentali, ma l’incontro con l’amministrazione del diritto delle istituzioni della Repubblica di Venezia è controverso e non lineare. Anche la elaborazione delle difese risentirà, in positivo e in negativo, delle difficoltà di questo incontro, e Marenzi, figura magistrale del foro di Padova per trentotto anni, conoscerà la sconfitta.
The author wants to draw the scholars’attention to a cross-section of the Paduan penal judicial world with reference to scientific and forensic aspects. The research is based on the Maleficio (Criminal tribunal) section of the rettorato (office of local chief executive) archive in Padua and the documents examine corpus refer to the lawyer Zorzi Marenzi’s work between 1751 and 1757. In particular, the author outlines this lawyer’s defensive options when he is faced with the crime of abortion and the use he makes of Academic scientific advice during trials. The city of Padua is the traditional seat of one of the most important and eminent western universities but its relationship with the administration of justice by the Venetian magistracy is difficult and controversial. Legal counsel is marked, in a positive or negative sense, by the difficulties of this relation and Marenzi, an imposing figure in the Paduan forum for thirty-eight years, was ultimately defeated.
