Food products certification is growing worldwide. UE choose a soft law approach, as result of Consultation promoted by Green paper on agricultural product quality of 2008, in order to introduce legal requirements in private certification schemes, adopting "EU best practice guidelines for voluntary certification schemes for agricultural products and foodstuffs". As far as legal certification schemes, the most significant in UE legal experience is that concerning organic standard certification. About this concern, it is possible to point out a wider role played by certification bodies accredited by national competent authorities, in most recent legislation. Rules introduced in 2013 show a wider flexibility in the activity of certification bodies, and in application of free movement of service rules within Member States. Reg. (EU) n. 392/2013 introduces a system for implementing exchange of information on production activity controls, in order to let possible a change between certification bodies on request of operators. Furthermore, organic farming regulation Draft of 2014 provides more flexibility on the activity of certification bodies carrying out controls on extra-UE products; it also promotes network between enterprises in order to simplify certification activities of control bodies. This trend - implementing free movement of services, related to the harmonization of accreditation rules - has also the effect to reduce Member State power on organic production, as originally provided by reg. 834/07.
