A tour operator cancelled a travel package by omitting to refund the traveler the full amount already paid, by not offering him an alternative package also of superior quality without additional price and by failing to provide essential information about tourist location’s sociopolitical situation. The State Council has decided that the tourists are entitled to full reimbursement or to alternative packages, even of higher quality, without additional price under article 42 Legislative Decree no 79/2011. Taking the cue from this judgement, it may be useful to consider whether or not, under the reformed Italian Tourism Code, travellers would be better protected in a similar case.
