Globalisation raises world welfare through increases in trade pushing economic growth and reducing poverty, but it worsens income discrepancies between skilled and unskilled workers in developed countries and between industrial workers and peasants in developing countries. Moreover, it does not benefit the poor living in countries that stay outside of the positive impact of globalisation on economic growth. As shown by the economic literature, the market is not responsible for income inequities, because it is neutral from the distributive side. The answer to the challenging equity issue is not protectionism built on barriers to trade and to the liberalisation process, but the adoption of political choices aimed at correcting income inequities both in developed and developing countries. The idea proposed in this work is to redefine the resource ?mobility? as a common good, which is produced by a collective action. In other words, the mobility of people and goods is both a structural aspect of the issue of environmental common reconstruction and a fundamental asset of a community of agents? social capital. The common good is thus socially constructed through the system of rights related to its use, reproduction or destruction, generated by the relationship network between agents. In the literature the debate seems mainly focused on the regulation of competition under conditions of ?externalities ? or market ?failures?, or on regulator failures, while a careful consideration of the strict linkage between structural generators (economic growth, demographic pressure, infrastructural weaknesses) and simultaneous failures both of the market and of the regulation policies can be rarely found. For this reasons, the aim of the present work is the construction of appropriate methodologies for the evaluation of scalable mobility policies suitable to be adopted from local level decision-makers to wider areas. Using an institutional framework that includes this social and iterated definition of the resource ?mobility?, we build indicators capable of modelling a traffic jam in its subjective determinants, and in order to check their reliability we test them against several case studies. The paper is completed by the formalisation of an example mobility policy, carried out using the proposed indicators. In other terms, in the model citizens can choose some local public goods without moving from one jurisdiction to another, as Buchanan?s and Tiebout?s theories would require. This theory appears especially suitable to explain and illustrate the evolution of the Italian case, in which the liberalisation of the energy sector has enabled the consumers to choose their own gas and electricity supplier. This could be achieved detaching the production and marketing of the service from the management of the related network. In this way, it is possible to introduce for the first time a real competition between suppliers of local public goods and to break off the monopolies of the local incumbent: citizens addressing the same seller, belong to the same ?functional jurisdictions?, while citizens living in the same area can belong to different jurisdictions. In the future, we can foresee the emergence of two kinds of jurisdiction: small jurisdictions, highly localized, where the supplied service is highly specialized and customised; and bigger jurisdictions, characterized by the exploitation of economies of scale, in which the supplied service is undifferentiated and cheaper. Nonetheless this particular structured finance process sets intricate problems of qualification, which necessarily influence the concrete configuration of the process of securitization de quo and, at the same time, the modality and typologies of legal actions which can be undertaken by the subjects of securitization. The present essay analyses in detail the ontology of the securitization of governmental real estate, assessing the fiduciary nature of the property right upon the real estate, sold to SPV (special purpose vehicle) or, better, SPC (special purpose company); then the private or public characterization of this particular kind of companies and, consequently, of the their acts and transactions and, moreover, the disposition of the public interests to conform the ontology and the teleology of the complex process of securitization of governmental real estates.
