The decrease in new orders in the niche market of cruise ships has become a serious risk for Fincantieri to manage. In the past two decades, the top management of Fincantieri has not mirrored the constant volume growth of global seaborne trade as well as the dramatic demand from the offshore industry, so giving way to stagnation of the overall productivity, uncontrollable growth of overheads, and gradual impoverishment in designing. Considering the current and perspective market situation, analyzing the strategy and capabilities of the major Korean shipbuilders, and evaluating strengths and weaknesses of Fincantieri as it is, I will suggest for a New Fincantieri some potential industrial and financial strategy: focusing on offshore units while keeping on cruising sector leadership, activating product diversification, and opening to international partnerships towards development of a global company. Title: Questioni giuridiche sulla legittimit? degli appalti (pensando alla cantieristica) Abstract: The idea of interposing a shield between actual employers and employees, together with the search for means saving one?s property from creditors? attacks, have always been cherished by civil law. In these terms, the lawfulness/ unlawfulness of employing labour not in one?s employ, in order to interpose a sort of working separation between the actual employer and the actual person exercising the economic activity by producing goods or services, is emblematic. The 1369/1960 Act restricted any interposing instance, but the 276/2003 Decree explicitly abrogated both the 1369/1960 Act and the discipline referring to articles 1-11 of the 196/1997 Act concerning temporary work. The aforesaid originated the new institution of administration of work, which has legitimised the supply of personnel through Administration Agencies. As far as contracts of mere labour are concerned, the 276/2003 Legislative Decree presents few measures, while ??internal contracts?? and their principle concerning the same treatment between a purchaser?s employees and a contractor?s ones are not treated at all. That does not mean that the discipline in force unconditionally legitimises any form of interposition in working services. Should the above normative measures be referred to the concrete case of "separate work" within a shipyard, the elements to be considered, by schematising, will be the following: Real organisation of the means used by the contract companies? employees; Control network or managing power network between the internal employees and the contract companies? ones; Contract risk, that is terms and quantification of payment for the contractor?s work or service. Title: Un cantiere navale per il mediterraneo. tecnologia, organizzazione e identit? navalmeccanica a Monfalcone Abstract: The Monfalcone shipyard was one of the last plants built inside the Italian economic space, and one of the largest. The objective of building in Monfalcone a shipyard for the Mediterranean, able to satisfy the larger part of Italian shipbuilding needs, was also confirmed after the First and the Second World War, with some difficulties during the Thirties in overcoming the global crisis. During the Fifties, the Monfalcone shipyard became a sort of laboratory-plant, with the aim of bettering the entire national shipbuilding. Its size became at the same time a handicap (the public ownership could not accept the massive dismissal of workforce) and an opportunity, because it led to a long lasting quest for technological innovation, competitiveness and new products and practices. In the Sixties, the attempt to realize a hybridization between local traditions and new production logics coming from Japan was not a complete success, due to some misunderstandings that led mainly to acquire the most superficial aspects of the Japanese model, giving less importance to the structural elements. This was a programming error that created a significant pressure over the workforce, with effects that proved to be negative until the Eighties. The negative dynamics of small firms specializing in the supply chain can be interpreted by the difficulties in achieving and maintaining adequate levels of quality characteristics of the markets for luxury goods. The accelerated development of the superyacht market has caused a qualitative increase in competition in the sector, and small businesses may have difficulties in maintaining adequate levels of efficiency. Other causes of the crisis can be identified in the industrialization processes affecting the major brands of luxury yachting: the connotations of accuracy and customization craft give way to the logic of efficiency, and the choice to start production in other countries reflects the fact that firms in the sector also tend to behave according to the typical strategies of globalized economic sectors. The wide Shipyard was first owned by CRN and then by Fincantieri, belonging to a large stock company comparable to most important companies in the European Naval Industry. The small Shipyard, Cooperativa Ing. Tommasi, was one of the minor Shipyards in Ancona, which also played an important role in the local economy and had national and international recognition for quality of products and professionalism of employed people. Similar evolutions, from artisan to industrial production, but in different times and in different ways took place in both Shipyards. Both realities at that time were characterized by the same professional capacity of men who have taken part on all levels and by the same entrepreneurial will and perseverance, that have allowed them to obtain results and recognition in a market sector, already then, exposed to strong international competition.
