International law has always been to a certain extent "liquid", flexible, hemmed in between the contingency of politics and of power relationships, and a theoretically highly demanding meta-legal universalism that is exposed to obvious practical risks. These days, there are plausible grounds for the perception that post-Westphalian international law - which is really a blend of hegemonies and humanitarianism, of super-sovereign immunities and globalism - is detached from the traditional debate about the legal, ethical or political nature of the ius gentium. Strategic and hegemonic interests have not simply fizzled away: they make use of the oscillating nature of post-classical international law to legitimise asymmetries and hierarchies
