The essay focuses on the two main forms of partnership between Public Administration and private entities: public procurement and public companies. The essay, which has the aim to analyze social implications of these specific form of public/private partnership, is divided in two parts. The first part deals with the exam of social clauses in public procurement, in particular with the specific provisions of the new Directive 2014/24/UE and Legislative Decree 50/2016. The second part deals with the new rules on public companies, represented by Legislative Decree 175/2016, particularly "in house providing" companies, trying to explain which are the actual and potential borders of the notion of "similar control".
