Trough an empirical approach to different legal provisions, the Author tries to verify if, and to what extent, individual autonomy is allowed to regulate the employment relation. The Author’s point of reference is the lesson of Massimo D’Antona, who invited to face the difficulties of such a research and to look for solutions which can be respectful of the employee’s individual capacity to deal with the employer and find good ways to regulate his interests. Binding legal provisions and collective agreements, indeed, try to protect employees from a general point of view and therefore may be not adequately respectful of individual employee’s interests.
