The D.lgs. No. 81/2008 has enhanced management systems of occupational health and safety, providing a variety of models and raising issues of coordination with the compliance programs provided by D.lgs. No. 231/2001, for exemption from administrative liability of legal persons offence. The essay deals, in particular, with the effectiveness of risk management in perspective with the performance of a duty and the employer’s liability.
