Broadly speaking, in the Spanish Legal System and in three Italian bills, the concept of economically dependent worker is used to describe the situation in which a consistent portion of worker’s income stems from one single client who becomes the primary source of worker’s subsistence. This article makes two critical points. First, the definition of economic dependency on the basis of quantitative remunerative parameters, despite appearances, does not increase legal certainty; second, to some extent, it appears to be inconsistent with the protection of the client’s freedom of contract. Finally, the article investigates whether quantitative parameters can justify the insertion of a social and distributive justice thinking into contract law.
