The French legal system combines two different approaches that apparently display sharp contradictions. On the one hand, it offers a strong protection of the employment stability imposing the employer to offer the employee a continuous job training that guaranties his or her professional capability. On the other hand, it strongly promotes employee performance evaluation. The A. analyses in details which factors in the French legal system make possible a balanced combination of these two different but at the same time complementary approaches.
