Having briefly analyzed the basic conditions for an intervention may be regarded as a State aid. The item analyzes the European Commission’s approach, and the jurisprudence on the same conditions applied to specific cases related to tourism and recreation activities. The item focuses especially, on the European Commission’s practice and jurisprudence analysis, on the impact on the exchanges between Member States, but also analyses other conditions: transfer of State resources, economic advantage and selectivity, effect on competition. The item ends considering some aspects of the approach of European Commission on the compatibility of aid with the internal market in this area.
