Giancarlo Passavalli Puecher was the first fighter of the Resistance to receive a gold medal in Lombardy. Born in Milan, Puecher joined the partisans after 8th September 1943, in Brianza, Como, where he had escaped with his family from the heavy Anglo-American bombing of Milan. Puecher organized the first corps of partisans of the province of Como at Ponte Lambro, near Erba, with some companions, including Franco Fucci. Arrested on the evening of 12th November 1943, while returning from Erba by bicycle with Fucci, he was imprisoned for over a month before undergoing a special military trial and being sentenced to death. The discovery of the trial documents of Giancarlo Passavalli Puecher in the records of the Tribunale militare Territoriale group conserved at the State Archive in Milan has allowed a reconstruction of the main phases of the trial, providing a further contribution to the knowledge of the procedures used by the judges and of what happened before and after the trials of Puecher and of the other seven accused people. The analysis of these documents evokes an image as ambiguous as tragic, in which, at the beginning of the Repubblica sociale italiana, military justice became a docile instrument in the hands of republican neo-fascism searching for an easy revenge. An angry fascism that was more interested in giving an appearance of legality to retaliation than in discovering the truth.
