The paper analyses recent regulations that have increased the special powers of control over foreign investments in the context of the relationship between the state and the market. These are the following items studied in the article: the organizational profiles of the Presidency of the Council of Ministers; the investigation and evaluation procedures, both at national and European level; the obligations of companies. The author highlights how the rationale of the institute has changed from an exceptional and limited means of protection against alleged economic aggression from non-EU countries, has become an instrument of control extended to the entire economic system, aimed at protecting it in its entirety, even on occasions that completely disregard the entry of foreign capital.
