This analysis is conducted by the author with special regard to the works of socalled contemporary art: i.e. the artistic forms that spread during the last century and the current one. Such artworks consist, contrary to those of the so-called classic art, not only in material works, such as sculpture or drawing, but also in "immaterial" works, such as the artistic performance. This difference raises several issues of a regulatory nature. The Author focuses on different rules concerning the transfer of ownership of material works and the transfer of ownership of performances. This analysis involves, in the first case, the investigation of the impact of the characteristics of artworks on the sale contract rules, and, in the second case, in the reading of the artistic performance from the perspective of intellectual work contract and of the assignment of credit claim.
