This article makes a comparative analysis of Italian and Spanish immigration legislation, a field of considerable significance for Europe, as Italy and Spain are the two countries toward which the majority of the migratory flow is directed. The principles underlying the legislation in these two Mediterranean countries with re-gard to the residence of immigrants from outside the European Union, based on the guidelines adopted by the EU as a whole, are similar with regard to the strict de-pendency of the residence permit on the availability of regular employment. Never-theless, there are some differences between the two systems, such as with regard to how clandestine immigrants can legalise their status. The comparative analysis of the two systems persuades the author to call for a fundamental rethinking of atti-tudes with regard to how the problem of immigration should be tackled.
