The essay questions the constitutional basis of the remedies for unlawful dismissal in small enterprises, which is less favourable than that applicable in larger ones, even after ruling no. 118/2025 of the Constitutional Court, which raised the maximum compensation cap provided for in Article 9 of Legislative Decree 23/2015. The denial of the right to full compensation for workers in small enterprises is all the more unreasonable when compared with the compensation protection guaranteed to workers protected by reinstatement. The anomalies and inconsistencies of the remedies in force in Italian legal system are contrasted with the straightforward approach taken by the European Committee of Social Rights on the basis of Article 24 of the European Social Charter, whose transposition into national legislation would, in the author’s opinion, be consistent with constitutional values and the general principles of civil law.
