The author examines the phenomenon of short-term rentals (STRs) as an expression of property “extractivism”, against the backdrop of the growing tension between individual interest, urban sustainability, and the protection of collective and general interests. After reconstructing the European and domestic regulatory framework, the article explores the relationship between STRs and the social function of property, highlighting their impact on the housing market, urban quality of life, and the territory. On this basis, the contribution investigates the role of private law and of the courts in fostering virtuous conduct from a sustainability perspective, showing how, despite the inherent limits of private-law remedies, the general interest may guide their interpretation and application in a constitutionally consistent manner.
