The author addresses the guest identification obligation under Article 109 t.u.l.p.s., with particular reference to self check-in in short-term rentals. She critiques Lazio TAR judgment no. 10210/2025 – which annulled the ministerial circular requiring in-person identification – arguing that removing the physical presence requirement weakens operators’ verification duties and risks undermining the preventive and control purposes of Article 109.
