This article focuses on access to justice as a fundamental human right in international and EU law. It aims at identifying the core contents of a European minimum standard on the effectiveness of internal remedies for the protection of individuals against human rights abuses. This right can be read through the lens of its normative history tracing back to the basic principles on diplomatic protection and denial of justice and their interactions with the local redress rule. The developments of access to justice in contemporary conventional human rights law contribute to clarify its character of customary law and general principle common to the constitutional traditions of EU member States
