The sentence under consideration focuses on the long-standing issue of compatibility between freedom of establishment (art. 49 TFEU) and directive 2006/123/CE about state-owned maritime concessions on one hand, and automatic extension of these concessions provided by Italian law on the other hand. The European Court of Justice denies this possibility, but it offers the Italian legislator some suggestions.
