The article introduces the legal themes of migration, an ordinary phenomenon for hu-manity, and of foreigners, an artificial notion created by the law of sovereign states, sometimes contradicting their fundamental principles. Classical juridical reflections did not prevent the forms of liberal state from controlling migration and the discretionary granting of asylum. Even in the forms of democratic-social state, the rules on foreigners are decided by representatives of citizens only, who in the era of global migration tend to limit potential competitors to scarce resources, but are bound by fundamental rights and the right to asylum guaranteed by constitutional, international and European standards. The Italian constitutional doctrine and jurisprudence is deepened.
