The reflections of this essay aim to enter into the complex definition of the central and essential nucleus of an institution, the school, which is at the heart of many public functions typical of a constitutional state with a social imprint. The analysis of the constitutional text, before any institutional or normative treatment, is useful for identifying those primitive elements that govern the system as a whole: the educational function and, therefore, education in a broad sense. The latter seems apparently far from the arid technicalities of legal analysis but is deeply innervated in many of the essential junctions of any system that we want to define democratic, according to all the declinations in which this fundamental qualification of our systems of government is expressed.
