– The Author examines the condhotel regulations, introduced by Law No. 164/2014, which implements and converts Legislative-Decree No. 133/2014, known as “Sblocca Italia,” which aims to encourage investment in the redevelopment of hotel businesses throughout Italy. The paper describes the institution’s usefulness and the critical issues surrounding the regulations contained in Prime Ministerial Decree No. 13/2018. After a reference to the changed content of the ownership institution, it examines the role of private autonomy in regulating private relationships within condhotels, with particular attention to the contract for the transfer of ownership from the hotelier to third parties, condominium aspects, the contractual regulations, their limitations, and enforceability against third parties. Furthermore, the important role of the notary is highlighted in reconciling, during the signing of the contract, the specific rules established by Prime Ministerial Decree No. 13 of 22 January 2018 with the condominium regulations amended by Law No. 220 of December 11, 2012, as well as the need for specific rules to protect the buyer as a potential weaker party in the contract.
