This contribution intends to reflect on the forum necessitatis that the European Union proposes to adopt by determining which jurisdictions of the Member States are competent to deal with questions relating to parentage in cross-border situations. The proposal for a European Regulation relating to jurisdiction, applicable law and the recognition of decisions and acceptance of public documents in matters of parentage and the creation of a European certificate of parentage, in reference to the “forum necessitatis”, poses from the point of interpretative point of view delicate issues regarding access to justice and the choice of the competent court in compliance with the principle of the best interests of the minor.
