The involvement of private actors in space and the prospect that they may engage in space mining activities have highlighted the gaps in the international framework governing the exploitation of cosmic resources. This article aims to examine the admissibility of space mining activities in light of international space law, analyzing the non-appropriation principle enshrined in the Outer Space Treaty, the state responsibility for the conduct of private activities in space, and the national legislations adopted so far, with a particular focus on Italian Law no. 89/2025.
