The article examines the nature of the activities carried out by a space operator within a public-private partnership concerning a satellite infrastructure or service. Through an analysis of Article VI of the Outer Space Treaty, of the criteria governing the attribution of private conduct to the State, and of the respective functions assigned to the parties in a PPP, it clarifies why the activities performed by the private partner remain “non-governmental.” This leads to significant implications: new obligations for operators, limited State responsi-bility, and an unprecedented intersection between PPP regulation and the regime established by Law n. 89/2025.
