The article, after analysing the evolution of the Constitutional Court’s case law over the last decade on unlawful dismissals and highlighting those aspects that may now be considered settled, calls into question the interpretative premises that have shaped its most recent developments. Since Judgment No. 45 of 1965, the Constitutional Court has excluded that the right to work (Article 4 of the Constitution) entails a right to job stability, thereby legitimising a plurality of remedies and the gradual reduction of the scope of reinstatement protection in favour of monetary compensation. The article offers a critical reassessment of this framework, questioning whether the exclusion of reinstatement as a constitutionally necessary remedy may stem from a restrictive interpretation of the labour principle, considering the conception of work as the foundation of the Republic and as a means of personal emancipation and social participation.
