The essay analyses the evolution of constitutional case law on dismissal for objective justified grounds in its interaction with Supreme Court case law. Particular attention is devoted, on the one hand, to Judgment No. 59 of 2021, in which the Constitutional Court censured the optional nature of reinstatement under Article 18 of the Workers’ Statute, and, on the other hand, to Judgment No. 125 of 2022, which addressed the issue of the manifest inexistence of the factual basis underlying the dismissal. The analysis then extends to the regime introduced by the Jobs Act, examined in the light of Judgment No. 128 of 2024. The essay concludes by expressing the hope that the legislature will heed the Constitutional Court’s warnings aimed at restoring unity to the current legal framework.
