The article critically examines the Italian system of collective bargaining, highlighting the shift from privatelaw representation to trade union representativeness as the central criterion of legitimacy. Through an analysis of key legislative and judicial developments, the Author underscores the emergence of models based on majority consensus and proposes interpreting collective agreements as a “source of fact,” effective in individual employment relationships through incorporation by reference.
