The article examines the Constitutional Court’s case law on migrants’ access to social security benefits, highlighting the tensions between the principle of equality and legislative discretion in light of constraints arising from European Union law. It focuses on three key issues: the distinction between essential and nonessential benefits; qualified residence requirements as conditions of access to social security; and the respective roles of reasonableness review and antidiscrimination adjudication, within the broader framework of judicial dialogue between courts. The resulting picture is not entirely linear. While some decisions expand the protection of migrants’ social rights, others adopt more restrictive approaches, underscoring the central – yet at times fluctuating – role of constitutional adjudication.
