The essay examines the New Space Eco-nomy as a phenomenon of structural transformation of the space sector, characterised by the growing participation of private operators across the entire space value chain. The analysis reconstructs the enabling factors of this transition – reduction of access costs, service-oriented business models and public-private partnerships – and the reasons that have led numerous European States to adopt national regulatory frameworks, in the absence of harmonisation at Union level and within the framework of international principles developed since the 1960s. Particular attention is devoted to Law No. 89 of 13 June 2025, Italy’s first comprehensive legislation on the space economy, examining its authorisation framework, the civil liability regime of operators and the State’s right of recourse, insurance obligations and the registration of space objects. The contribution highlights the tension between openness to private initiative and public oversight, in the perspective of the EU Space Act and Article 189 TFEU.
