An in house providing company can lawfully carry out tourist activities and services. Private shareholders are allowed in the company’s capital provided that they do not exert any direct control over its strategic decisions and activities. The article includes an analysis of a recent decision taken by the Italian Supreme Administrative Court, which addresses the regional powers in setting up DMOs (Destination Management Organisations) to accomplish public interest.
