A guidance aimed at recognizing a tort action as a consequence of the breach of the right to enjoy an organized vacation, is making its way in jurisprudence. The possibility to compensate ruined vacation damage also as a consequence of tort must, however be analyzed according to the principles set forth by the Supreme Court with reference to compensation of non economic losses in order to avoid indiscriminate and wanton enlargement of the perimeter of such damage. The above analysis should be carried out strictly in order to avoid attempts to circumvent the evaluation of the constitutionally qualified injustice that should preside over the liquidation of non economic losses other than those already legally typed
