The essay examines the conflict between legislators and national and European judges regarding maritime state concessions. Analyzing the Council of State’s ruling no. 4479/2024, the author reaffirms the illegality of generalized extensions and the prevalence of European law. The concepts of resource scarcity and cross-border interest are explored in depth, as well as the environmental and social value of beaches as common goods. The contribution concludes by calling for an organic reform that reconciles competition, environmental protection, and sustainable management of coastal public property.
