This paper aims to examine issues relating to legal protection of innovations in agriculture and the safeguard of biogenetic resources. On the one hand, the national legal orders stimulate inventive activity through the recognition of the inventor’s exclusive right to exploit the innovation but, on the other hand, the conservation and protection of biological diversity, in general, and of agricultural biodiversity, in particular, are considered the main tools to prevent the gradual loss of biogenetic resources. The developing countries must play an active role to balance these needs. The existing legal instruments must be improved and completely used for the protection of biogenetic resources.
