The article addresses the problematic issue of the control of European Union ultra vires acts by the Constitutional Courts which became a topical subject after the first ultra vires statement in the framework of european integration process made by Czech Constitutional Court and in consequence of the first preliminary ruling filed by German Constitutional Court as regard an act overstepping EU competences. In this perspective, it is preliminarily explained that in support of this competence which strictly would be clearly unaccetable in the framework of european legal order, some Constitutional Courts have expressly referred the derivative nature of european system and of its relative organization as well as the legal ownership of the Kompetenz-Kompetenz vested in the Member States. In the attempt to find the meeting point between the two perspectives, the author aims to demonstrate that the questioning of some unavoidable requirements of european integration process results not in itself, by affirming of national role of control, but from its operating mode. For this reason the comparison between the recent German and the Czech constitutional jurisprudence that from a common conception of relationships between European Union and Member States have drawn different methods of assessing the nature of ultra vires european acts, shows a peculiar framework of analysis useful to know if and in which measure it is possible and accettable a role of Constitutional Courts in determining the fluid borders between National and european competences
