The theory of sources is a structural element of the separation of powers. The issue criticizes the opinion which tends to confuse the theory of sources with the theory of interpretation by giving the judge-interpreter the ‘function’ to maximize the protection of rights. The ‘crisis’ of source system goes back to the crisis of the political system.
