This contribution constitutes a comment on a ruling of the European Union Court of Justice about the notions of “accident” and “contributory negligence” (Arts. 17, para. 1, and 20 of the 1999 Montreal Convention), in the context of air carrier liability for injury of passen-gers. Through the analysis of the topics addressed, the work aims to highlight the main novel and interesting profiles of the ruling, which is oriented towards a high level of passenger pro-tection.
