The Court of Justice of the European Union ruled on the classification of airport staff shortages in baggage handling as an extraordinary circumstance under Article 5, §3, Regulation (CE) n. 261/2004. The case concerned a long delay of the Cologne-Bonn/Kos flight, partly attributable to the insufficient staffing of the airport operator. The Court held that such an event may constitute an extraordinary circumstance, as it is neither inherent in the normal exercise of the air carrier’s activity nor within its effective control. However, it reaffirmed that the carrier bears the burden of proving that it adopted all the reasonable measures to avoid or limit the consequences of the delay
