The essay deals with Directive (EU) 2023/970 on equal pay for men and women, highlighting its systemic significance in the evolution of European antidiscrimination law and in the strengthening of the principle of effectiveness. Pay transparency is reconstructed not as a mere information obligation, but as an instrument for uncovering and scrutinising the criteria governing the determination of pay, capable of affecting both employers’ prerogatives and collective systems of classification and grading. Attention is devoted to the notion of pay, the concept of work of equal value, the need for genderneutral evaluation methodologies, and coordination with the directives on equality bodies. The contribution also examines the role of the social partners in joint pay assessment and in the removal of pay disparities, showing how the Directive requires a review of collectively agreed classification and pay systems. From this perspective, the Italian implementation through Legislative Decree No. 96/2026 is critically assessed, with particular emphasis on its possible conflict with Directive (EU) 2023/970 in several respects. According to the Author, the effectiveness of the principle of equal pay will depend on the ability of the domestic legal order to overcome the limited implementation of pay transparency carried out by Legislative Decree No. 96/2026, orienting it towards the substantive transformation of remuneration and collective bargaining systems.
