The new Treaty on the Functioning of the European Union (TFEU) provides (Article 23) for the right of EU citizens to diplomatic and consular protection by member states other than the State of nationality in the territory of a third country. The main question is: what are the contents of the diplomatic and consular protection established with such provision of primary EU law? Is it a typical notion of public international law or rather a new concept with autonomous meaning within EU law? The essay addresses this issue by examining the manner and form in which takes shape the right of EU citizens to obtain protection from another member state, when staying ‘abroad’ in the territory of a third country. The essay also focuses on the role of the European external action service in ensuring such protection to EU citizens in the territory of a third country where are not available diplomatic and consular services of EU member states
