The most important issue is the difference between the role and responsibility of the tour operator and the travel agent regarding the failure of the travel package. The tour operator is responsible for the failure to provide the tourist services included in the package or for the quality difference compared to what is advertised in its catalog; the travel agent responds according to the professional diligence of the intermediary. The joint liability is not applicable. The traveler must prove in court the non-differentiation in the travel contract between the tour operator and the intermediary travel agent. The traveler is required to carry out the ordinary diligence in receiving and evaluating the information provided on the travel proposal with respect to his own wishes.
