The comment examines the decision of the Court of Cassation called once again to rule on the criminal relevance of the conduct consisting in the failure to communicate the customers’ de-tails to the public security authority by the person in charge of running a hotel. The sentence takes the opportunity to entirely retrace the tormented regulatory evolution of art. 109 t.u.l.p.s., which in the past thirty years has been the protagonist of multiple reforms which have consequently generated hermeneutic doubts.
