The Author deals with Amartya Sen’s most recent contribution, The Idea of Justice, of which three main topics are highlighted (the general methodology, the principle of impartiality, the capability theory), whose potential implications on the Labour Law debate are then discussed. The author concludes, on one hand, that the capability theory can be fit for Labour Law as a possible synthesis of the principles of freedom and equality. On the other hand, however, Labour Law should open more to the comparative and pragmatic approach and to the principle of impartiality, which are strongly emphasized by Sen.
