EHR and donation of organ and tissues: the manifestation of consent or the rejection of critical issues and future prospects. The transplantation of organs and tissues is a medical practice of fundamental importance, sometimes the only recourse to solve some serious diseases. An essential element, because it can proceed to transplant, is the manifestation of the donor’s expressed consent. The author is responsible for dealing with legal issues that revolve around the aforementioned expression in light of recent regulatory action, which introduced the possibility of including the same in the Electronic Health Record. Then, the author reconstructs the regulatory framework and poses the EHR in relation to the current organization of the transplant system outlining the critical issues and future prospects in consideration of the European directives on the matter.
