In public procurement, the introduction of environmental award criteria raises the issue of balancing sustainability and competition. These criteria aim to guide public spending toward ecological objectives, but they may affect the competitive market. This contribution examines, in light of EUbased regulations, whether the protection of competition should take priority over sustainability or whether the two objectives can coexist. Particular attention is devoted to the judgment T.B. et al. v. C.B. et al. (CJEU, 1 August 2025), which highlights the importance of ensuring maximum openness to competition even in procurement procedures concerning the purchase of green certificates.
