The paper provides a comparative analysis of hygiene standards in the EU, Polish and Italian law. Its aim is to determine whether the Polish legislature used the competence left to him by EU regulations, to determine the national measures of hygiene that facilitates direct sales, while providing the safety of health public. In conclusion the Author formulates an assessment in relation to the level of restrictiveness of Polish requirements on the background of the Italian. It was found whether the Polish or EU legislator creates unjustified or excessive barriers for direct sales and, consequently, who bears the burden of meeting the challenge of determining the legal standards which take into account consumer expectations (in terms of acquisition directly from the producer of a wide variety of foods that meet the relevant standards of hygiene) and producers (in terms of the sale of a wide variety of foods with minimal formal and legal duty).
