Two different courts have ruled on the responsibility of a tour operator for the physical and mental damage suffered by tourists in the same terrorist attack that occured in Tunis. The stop in Tunis was included by the tour operator in its cruise itinerary. The alleged responsibility falls under two different categories: not having observed the appropriate precautions in choosing the destination, including a place in which the risk of terrorist attacks was largely predictable; and not having informed customers of this risk by violating the diligence required of the professional tour operator who should have provided its passengers with all the information necessary to avoid being exposed to the risk of attacks. Both rulings analyse the extent of what the tour operator has to inform clients, and the qualification of the attacks as unpredictable events such as to exempt the latter from responsibility.
